This week the FCC initiate a Rule Making proceeding FCC 10-86, seeking to correct “a patchwork of rules governing renewal and discontinuance obligations for wireless services, such as cellular, personal communications services (PCS), specialized mobile radio (SMR), and wireless communications service (WCS).”
The proposed Rules specifically target commercial or quasi-commercial services licensed under Rule Parts 22, 24, 27, 90, and 101, among others. The FCC “tentatively conclude[s] to adopt and apply the renewal framework that the Commission established for the 700 MHz Commercial Services Band in the 700 MHz First Report and Order to services licensed by geographic area and, with certain refinements, to services licensed by site.” While the item does not appear to impact private land mobile, SCADA, telemetry or point to point microwave licenses, those entities offering commercial services will need to include detailed information on their level of service when confirm compliance with construction requirements or renewing their licenses. Further information on this rule making proposal is available from UTC legal/regulatory department staff.
